Terms of use

1. Scope of use

1.1 Use of the Internet pages (hereafter referred to as: 'VIVO Website') provided by the proprietor is only permitted subject to these terms of use. These terms of use can in individual cases be amended, modified or replaced by other terms and conditions, e.g. for the purpose of purchasing products and/or services. In the event of conflicting terms, said other terms and conditions shall prevail over these terms of use.

1.2 The user accepts these terms of use in their corresponding version by logging in, or, in the event that a separate login is not required, by commencing use.

1.3 Providing that the user of the VIVO Website is not a consumer in the sense of the Austrian Consumer Protection Act § 1 (hereafter referred to as: 'consumer'), §§ 9, 10 of the Austrian E-commerce Act do not apply.

1.4 The proprietor is legally entitled to completely or partially shut down the operation of the VIVO Website or to change the contents of the VIVO Website at any time. Due to the nature of the Internet and of computer systems, the proprietor cannot accept any liability for the uninterrupted availability of the VIVO Website.

2. Right of Use

2.1Use of the information, software, documentation and other contents (hereafter referred to as: 'contents') made available on the VIVO Website is subject to these terms of use. Separate terms of use or license terms of the proprietor shall prevail over these Terms of Use.

2.2 The proprietor grants the user a non-exclusive and non-transferable right to use the contents made available on the VIVO Website to the extent to which it is stated on the VIVO Website or, if no statement of extent is made, to the extent of the purpose intended by the proprietor in making the contents available.

2.3 Neither information, nor software, nor documentation nor other contents of the VIVO Website may be sold, leased or in any other way made available to third parties. Unless permitted by mandatory law, the user may not modify, edit, retro-engineer or disassemble either the software or its documentation, or delete parts. The user is permitted to create one backup copy of the software, if the backup copy is required for future use in accordance with these Terms of Use.

2.4 The contents of the VIVO Website are protected by copyright laws and international copyright treaties and by other laws and conventions related to intellectual property. The user will observe these laws.

Intellectual Property

3.1 Information, brand names and other contents of the VIVO website may not be changed, reproduced, sold, rented, supplemented or used in any other way without prior written consent from the proprietor.

3.2 Except for the rights explicitly granted herein, the user is not granted additional rights of any sort, especially in regard to the name of the company or industrial property rights, such as patents, utility patents or brands, nor is the proprietor under any corresponding obligation to grant such rights.

4. Hyperlinks

Links from the VIVO website to other Internet pages are a service offered to the Internet user. The use of a particular link is at the user’s own risk. The proprietor is not responsible for the links’ function and is not liable for the content of the websites that are linked to. The proprietor explicitly distances themselves from the contents of external internet-sites that are linked to from this site.

5. Liability, Viruses

5.1 The contents of the VIVO Website may contain general descriptions of technical possibilities of individual products, which, in certain cases (e.g. due to product changes), may not always be available. The required performance characteristics are thus in each case to be agreed upon at the time of purchase.

5.2 Although the proprietor continually endeavours to keep the VIVO Website free from viruses, a virus-free environment cannot be guaranteed. Prior to downloading information, software, documentation or other contents, the user will ensure the presence of appropriate safety precautions and virus scanners for his/her own protection and for the prevention of viruses on the VIVO Website.

6. Place of Jurisdiction, Applicable Law

6.1 The sole place of jurisdiction shall be Vienna

6.2 Austrian Law applies.
